HS2 steams ahead in court battle
The HS2 is a highly controversial High Speed Railway Network that is set to link the North of England to the Midlands and London but today the Government won nine out of ten points challenged in a High Court after protest groups tried to stop the HS2 going ahead.
The only point challenged that was agreed with was the consultation into compensation for those affected by the HS2 which was ‘ruled unlawful’ by Mr Justice Ouseley.
There were five judicial reviews that were brought by the protest groups which includes 19 councils, a golf club and a campaign group called High Speed 2 Action Alliance who represent more than 70 affiliated groups and residents’ associations.
They all claimed that there were major failures in the consultation process as well as the assessment of the HS2’s impact on the environment. However, the judge has ‘given the green light’ for the project to move forward, subject to necessary parliamentary approvals according to Mr Burns who spoke after the court hearing.
He also confirmed that the Government will not appeal against the compensation ruling but they will not hold another property consultation. There are 172,000 properties within 0.6 miles of the first phase of the HS2 will be allegedly affected and Hilary Wharf, the director if the High Speed Action Alliance stated that the judgement was ‘a huge victory for the hundreds of thousands of people whose lives are blighted by the HS2.’ She claims that there are many compensation alternatives which will be better for the residents that are ‘trapped by the HS2’ and the Government will have to ‘go back to the drawing board’.
One of the claims that was dismissed by the judge was made by Camden London Borough Council who stated that the proposals to enlarge Euston Station will have a detrimental effect on the local ethnic minority community. Another case that was dismissed was a claim that the government failed to adequately assess alternatives to the HS2.
